TITLE
RESOLUTION AMENDING RESOLUTION NO. R-937-98 MAKING IT A MANDATORY REQUIREMENT FOR CONTRACTORS TO POST NOTICE OF JOB OPPORTUNITIES RESULTING FROM THE CONSTRUCTION OF IMPROVEMENTS ON COUNTY PROPERTY THROUGH THE COUNTY'S CLEARINGHOUSE PROCESS

WHEREAS, this Board desires to accomplish the purposes outlined in the accompanying memorandum, a copy of which is incorporated herein by reference,

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that this Board authorizes an amendment to Resolution No. R-937-98, making it a mandatory requirement for contractors to post notice of job opportunities through the County's Clearinghouse process resulting from the construction of improvements on County property, as provided in the accompanying memorandum for the County and to include appropriate implementing language in prospective construction contracts prior to bid following the review and approval thereof by the County Attorney's Office.

STAFF RECOMMENDATION
It is recommended that the Board amend Resolution No. R-937-98, which established the Clearinghouse for Posting notices of Job Opportunities resulting from the Construction of Improvements on County Property to make job reporting mandatory.

MANAGER'S BACKGROUND
On July 21, 1998, the Board adopted a resolution, sponsored by Commissioner Dorrin D. Rolle, establishing the Job Clearinghouse concept. In December, 1998, the County established a procedure (attached) to ensure appropriate notification of job opportunities and advising appropriate departments how to implement the program.

To date, the mechanics of how the program is to work has been put into place. All departments were provided with packets informing them of the steps in the Clearinghouse process and their responsibility to include suitable language in contracts offered for improvements on County property. ERD staff joined other department representatives at certain pre-bid conferences to remind bidders of the resolution. Despite these efforts by the County, only three (3) construction contractors have voluntarily returned the Job Order Request Form to advise the County of new job opportunities. The weak response from contractors indicates that the objectives of the resolution are not being achieved due to the voluntary nature of the requirement Commissioner Rolle and other members of the commission have raised understandable concerns with the lack of response from our contractors.

This recommendation amends the previous resolution by making the job posting procedures mandatory. In addition, this amendment will also enhance the success of the Clearinghouse project by ensuring that the community is notified of all available job opportunities resulting from improvements on County property. When adopted, this procedure will mandate that all successful bidders comply with the Clearinghouse procedures within ten (10) working days of the contract award.
