REPORT: | Assistant County Attorney Jess McCarty read the foregoing proposed resolution into the record. Responding to Ms. Miriam Singer, Director, Procurement Management Department, requesting this proposed resolution be considered at the next County Commission meeting, pursuant to the urgency of Item 1.2: Mechanical Integrity Testing of Deep Injection Wells and Associated Services, Vice-Chairman Gimenez noted he would prepare a memorandum requesting that Chairman Barreiro waive the Board's Rules and Procedures to allow this proposed resolution to be considered at the May 20, 2008, County Commission Meeting. Hearing no other questions or comments, the Committee proceeded to vote. TITLE RESOLUTION AUTHORIZING AWARD OF COMPETITIVE CONTRACTS, WITH AUTHORITY TO EXERCISE OPTIONS-TO-RENEW ESTABLISHED THEREUNDER FOR THE PURCHASE OF GOODS AND SERVICES BODY WHEREAS, this Board desires to accomplish the purposes outlined in the accompanying memorandum, a copy of which is incorporated herein by reference, NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that this Board authorizes award of competitive contracts, with authority to exercise options-to-renew established thereunder, for the purchase of goods and services. Burgess County Manager Subject: Resolution Authorizing Award of Competitive Contracts STAFF RECOMMENDATION Recommendation It is recommended that the Board of County Commissioners approve the attached award of competitive contracts, with authority to exercise options-to-renew and contract modifications. Contract amounts and department allocations represent the maximum spending authority based on past utilization. This action does not guarantee that the total contract amount/value will be expended by County departments and/or agencies. Scope The impact of the items in the accompanying Award of Competitive Contracts Package is countywide in nature. Fiscal Impact/Funding Source The accompanying Award of Competitive Contracts Package states the allocation amount and funding source for each department utilizing a contract. Funding will be expended only if departmental budgets can support the expenditures approved in their Resource Allocation Plan adopted annually by the Board. Per Ordinance No. 02-116, the use of People�s Transportation Plan (PTP) surtax funds requires Board approval, regardless of the dollar amount. The allocated PTP surtax funds will support expanded operations associated with the implementation of capital improvements, maintenance, and/or operations as described by the PTP legislation (Ordinance No. 02-116) and its amendments, including but not limited to Resolution No. R-1154-03 adopted on October 9, 2003, which added the Miscellaneous Capital Improvements Projects List and authorized significant infrastructure improvements for existing Miami-Dade Transit facilities. Track Record/Monitor There are no known performance issues with the vendors recommended for award in the accompanying Award of Competitive Contracts Package. Each department�s contract manager is reflected in the accompanying Award of Competitive Contracts Package. Delegated Authority If this item is approved, the County Mayor or his designee will have the authority to exercise in his discretion subsequent options-to-renew, extend contracts and for purchase of goods and services in accordance with the terms and conditions of the contracts listed in the accompanying Award of Competitive Contracts Package. MANAGER'S BACKGROUND Background Section 1 AWARD OF COMPETITIVE BIDS The contracts listed in this section, are being recommended for award to the lowest priced, responsive, responsible bidder who met the bid specifications in accordance with established polices and procedures. Item 1.1: Mobile Fuel Supply and Delivery Service is to award a contract to purchase mobile fuel supply and services for various County department. The amount being requested is $1,017,700. Item 1.2: Mechanical Integrity Testing of Deep Injection Wells and Associated Services is to award this contract for testing of deep injection wells and associated services for monitoring wells for the Miami-Dade Water and Sewer Department. The amount being requested is $2,887,002. Section 2 REJECTED BIDS A bid may be rejected when adverse conditions exist such as the proposal not conforming to the specifications and/or solicitation documents, insufficient financial resources, technical ability, physical capacity and/or skill of the vendor, unfair and unreasonable pricing, insufficient competition and for any other cause in the best interest of the County. Section 3 COMPETITIVE CONTRACT MODIFICATIONS A competitive contract modification is an award of a supplemental allocation for goods or services within the scope of the original contract award. There are no items for this section. Section 4 PURCHASES MADE UNDER COMPETITIVELY AWARDED CONTRACTS OF OTHER GOVERNMENTAL ENTITIES The County occasionally accesses contracts competed and awarded by federal, state and local governments, and by not-for-profit organizations, when it is legally permissible and, it is determined to be in the best interest of the County, and the item is not available through an existing County contract. Section 5 APPROVAL OF THE USE OF PEOPLE�S TRANSPORTATION PLAN SURTAX FUNDS Per Ordinance No. 02-116, the use of People�s Transportation Plan (PTP) surtax funds requires Board approval, regardless of the dollar amount.
