The Labor and Employment Section provides legal advice and representation on workforce-related matters for the Board of County Commissioners, the Mayor, the Clerk of Courts, the Property Appraiser, the Tax Collector, Jackson Health System, and over 25 County departments and related agencies, all with a combined workforce of over 38,000 employees. The vast majority of the County's employees are in collective bargaining units that enter into collective bargaining agreements that are approved by the Board of County Commissioners. In addition, bargaining and non-bargaining County employees are covered by numerous state laws, as well as County ordinances, resolutions, rules, policies, and procedures.
Our attorneys provide sound advice and counsel regarding the full gamut of labor issues arising from the public sector collective bargaining process under Florida state law, and all aspects of relations with collective bargaining agents. We also provide day-to-day guidance to our clients on a wide variety of employment issues related to hiring, promotions, employee discipline, state and federal anti-discrimination laws, whistleblower claims, wage and hour matters, family and medical leave, employee benefits, retirement, and reasonable accommodation requests. Our section is comprised of experienced trial lawyers who represent the County and its related agencies in litigating labor and employment matters before state and federal courts; before federal administrative agencies such as the Equal Employment Opportunity Commission ("EEOC") and the U.S. Department of Labor; before state agencies such as the Florida Public Employee Relations Commission ("PERC") and the Florida Commission on Human Relations ("FCHR"); in internal civil service appeal hearings; and in arbitrations. Because of our subject matter expertise and experience, we also draft proposed County legislation and legal documents that arise in the labor and employment context.
