The Environmental, Code Enforcement and Foreclosures Section represents the County's Department of Regulatory & Economic Resources, as well as aspects of the Fire Rescue Department, the Solid Waste Department, and the Finance Department's Division of Credit and Collections in matters regarding compliance with the Code of Miami-Dade County, including, among other things, ordinances and regulations that help to preserve Miami-Dade County's natural resources, and to protect two national parks, Everglades National Park and Biscayne National Park. Attorneys in the section also handle matters involving the Comprehensive Environmental Response, Compensation, and Liability Act ("CERCLA"), a federal statutory program administered by the United States Environmental Protection Agency that provides a federal "Superfund" to clean up uncontrolled or abandoned hazardous-waste sites as well as accidents, spills, and other emergency releases of pollutants and contaminants into the environment. Our attorneys litigate regulatory enforcement actions brought by the County to ensure compliance with a variety of County ordinances and regulations concerning fire safety, environmental protection, zoning, unsafe structures, Florida Building Code, public works, and solid waste management.
We also provide legal advice and support to the Board of County Commissioners, the Mayor, and quasi-judicial and advisory agencies that administer the County's overall land use and environmental protection programs including, among others, the Environmental Quality Control Board, the Unsafe Structures Board, and the Nuisance Abatement Board. Additionally, our attorneys pursue foreclosure actions regarding defaults on mortgages issued by the County, as well as court orders to distribute surplus funds remaining from clerk of court auctions of foreclosed properties to satisfy unpaid code enforcement liens relating to those properties. Finally, our team drafts local ordinances and regulations for consideration by the County Commission concerning environmental protection, zoning, and unsafe structures, and we handle federal and state litigation challenging County ordinances and regulations relating to both land use and the procedural mechanisms to enforce provisions of those ordinances and regulations.
